By accessing or using MindQuest ("the Platform", "we", "us", "our"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use MindQuest.

MindQuest is a gamified, AI-powered learning platform designed to help students and learners engage with educational material. We reserve the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

MindQuest may be used by individuals who are at least 13 years of age. Users under the age of 13 must have verifiable parental or guardian consent before using the Platform. Users between 13 and 18 years of age are considered minors and their use of the Platform is subject to parental oversight.

By registering an account, you confirm that:

• You are at least 13 years old, OR you have obtained valid parental/guardian consent.
• If creating an account on behalf of a minor, you are their parent or legal guardian.
• All information you provide during registration is accurate and truthful.

To access full features of MindQuest, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorised use of your account.
• Ensuring your contact information is kept up to date.

We reserve the right to suspend or terminate accounts that violate these Terms.

Family plan subscribers may create learner profiles for minors. As the account holder, you (the parent or guardian) are fully responsible for:

• All activities performed under learner profiles.
• Ensuring that the learner's use of MindQuest complies with these Terms.
• Monitoring learner activity and content consumption.
• Setting appropriate PINs and access controls.

MindQuest uses artificial intelligence to generate educational content including lessons, flashcards, quizzes, and summaries. You acknowledge that:

• AI-generated content may occasionally contain inaccuracies or errors.
• Content is generated for educational assistance only and should not be relied upon as authoritative fact.
• We are not liable for decisions made based on AI-generated content.
• Third-party AI providers (e.g., OpenAI, Google) may process your prompts and inputs to generate content.

MindQuest offers free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Subscriptions are billed on a recurring basis (monthly or annually).
• A 7-day free trial may be offered for new subscribers.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Refunds are subject to our Refund and Subscription Policy.
• Prices are listed in South African Rand (ZAR) and may be subject to change with notice.

You agree to use MindQuest only for lawful educational purposes. You must not:

• Use the Platform for any illegal or unauthorised purpose.
• Attempt to reverse-engineer, scrape, or exploit the Platform or its AI systems.
• Upload content that is hateful, abusive, obscene, or harmful.
• Impersonate another person or entity.
• Circumvent any access controls or security measures.
• Share or resell your account credentials.

All content, branding, design, and technology on MindQuest is the intellectual property of MindQuest and its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

You retain ownership of any study materials or content you upload. By uploading content, you grant MindQuest a limited licence to process and transform that content into educational materials for your personal use on the Platform.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

By using MindQuest, you consent to the collection and use of your data as described in our Privacy Policy.

MindQuest is provided "as is" without warranties of any kind. To the fullest extent permitted by applicable law:

• We do not guarantee uninterrupted or error-free access to the Platform.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of MindQuest.
• AI-generated educational content is not a substitute for professional tutoring, medical, legal, or other professional advice.

We reserve the right to suspend or terminate your account at any time if you violate these Terms, without prior notice. You may close your account at any time from your account settings.

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of South Africa.
